New Zealand’s Overseas Investment Office (OIO) groups home buyers by their citizenship, residence status, and the type of land. Who can buy without consent?
New Zealand citizens can buy a home without overseas investment consent. A person with a New Zealand residence class visa can also do so when they meet the ordinary residence test. Australian and Singaporean citizens have exemptions for some residential or lifestyle land. Extra sensitivity, such as an island location, can change the result. Australian and Singaporean permanent residents have different conditions.

Waterfront land needs care
A waterfront property can be sensitive for reasons beyond its residential classification. Its location, size, and relationship to the foreshore, a lake, or an island can matter. A New Zealand lawyer with overseas investment experience can check the title and the rules for the specific property.
Possible consent pathways
Some residence class visa holders who are not yet ordinarily resident may apply for consent to buy a home to live in. Qualifying investor visa holders may be able to apply to buy or build a home above NZ$5 million, subject to the OIO’s conditions and land sensitivity rules. There are separate pathways for development and other investments.

- Check the current OIO rules and whether consent or an exemption applies.
- If consent is needed, make any sale and purchase agreement conditional on receiving it.
- Prepare the application and allow time for the OIO decision before settlement.
- Get independent tax, finance, and currency advice for the transaction.
